Service Agreement and Booking Policy

Thriving Together Client Service Agreement and Informed Consent

This agreement explains the nature and limits of the services provided by Thriving Together. Please read it carefully before booking a session.

1. Parties

This agreement is between:

Thriving Together and the client

2. Nature of the service

 

Thriving Together provides non-clinical perinatal education, practical guidance, emotional support and general wellbeing information.

 

Sessions may be provided online or in the client’s home, depending on the service booked, client preference and availability.

 

Thriving Together does not provide medical diagnosis, medical treatment, midwifery, nursing, psychotherapy, emergency care or any other regulated health service unless expressly stated otherwise in writing.

 

3. Professional status and scope

The client understands and agrees that:

  • The provider is a non-registered professional and is not acting as a registered doctor, midwife, nurse, psychologist, psychotherapist or other registered health practitioner.

  • The provider will work only within their training, experience and professional scope.

  • Information shared during a session is general educational and supportive information. It is not individual medical advice and must not be treated as a diagnosis, prescription or treatment plan.

  • The provider will not perform clinical examinations, diagnose a condition, prescribe or adjust medication, or instruct the client to disregard advice from a registered health practitioner.

  • Where an issue falls outside the provider’s scope, the provider may recommend that the client contact an appropriate registered health practitioner or support service.

The client is encouraged to discuss any concerns about their own health, pregnancy, birth, postpartum recovery, mental health or baby’s health with their lead maternity carer, midwife, doctor, Well Child provider or another appropriately qualified practitioner.

4. Not an emergency service

 

Thriving Together is not an emergency, urgent-care or crisis service. The provider may not see or respond to calls, texts, emails or online messages immediately.

The client must not rely on Thriving Together to assess, monitor or respond to an urgent or potentially life-threatening situation.

If the client is worried about their own immediate safety, their baby’s safety or another person’s safety, they must call 111or attend the nearest emergency department.

For urgent pregnancy, labour, postpartum or newborn concerns, the client should immediately contact their lead maternity carer, midwife, doctor or maternity unit.

Contacting Thriving Together does not replace seeking appropriate emergency or medical care.

5. Medical decisions and client responsibility

The client remains responsible for decisions concerning their own health, pregnancy, birth, postpartum care and baby’s health.

The client agrees to seek advice from an appropriately qualified and registered health practitioner before making, delaying or changing a medical decision, treatment, medication or care plan.

Thriving Together does not make medical decisions on behalf of clients. Any decision made after a session remains the decision of the client and, where applicable, the client’s registered healthcare provider.

 

To the fullest extent permitted by New Zealand law, Thriving Together is not responsible for harm or loss arising from:

  • the client treating general information as individual medical advice;

  • the client failing to seek timely medical or emergency assistance;

  • the client withholding relevant information;

  • the client acting contrary to advice from a registered health practitioner; or

  • an independent medical or parenting decision made by the client.

 

Nothing in this agreement excludes or limits any right, guarantee, duty or liability that cannot lawfully be excluded, including applicable rights under the Consumer Guarantees Act 1993 or the Code of Health and Disability Services Consumers’ Rights.

 

6. No guarantee of outcome

 

Thriving Together will provide its services with reasonable care and skill. However, individual circumstances differ, and no particular pregnancy, birth, feeding, recovery, parenting, health or wellbeing outcome can be promised or guaranteed.

 

7. Communication with healthcare providers

 

Thriving Together does not replace the client’s healthcare team.

 

With the client’s consent, the provider may communicate with a registered health practitioner or other support provider when this is reasonably necessary to support continuity of care.

Consent may not be required where disclosure is permitted or required by law, including where there is a serious and imminent concern about the safety of the client, a baby, a child or another person.

 

8. Client information and privacy

 

Thriving Together may collect personal and health-related information that is reasonably necessary to provide and administer the service.

The provider will take reasonable steps to protect the client’s information and will use or disclose it only for the purpose for which it was collected, with the client’s permission, or where permitted or required by law.

The client may request access to or correction of their personal information, subject to applicable New Zealand privacy law.

 

9. Respectful and safe sessions

Both parties agree to communicate respectfully.

For home visits, the client will provide a reasonably safe environment. The provider may leave or end a session if they reasonably believe the environment is unsafe, threatening or unsuitable.

 

The client may pause or end a session or withdraw consent to the service at any time.

 

10. Booking and payment

 

Full payment must be made online before the session. A booking is confirmed once payment has been received and booking confirmation has been issued.

 

11. Cancellations and rescheduling

 

The client should provide at least 24 hours’ notice when cancelling or rescheduling.

Cancellations with less than 24 hours’ notice are normally non-refundable. This charge will not apply when the cancellation results from labour or a perinatal emergency. In those circumstances, the session may be rescheduled or refunded.

If Thriving Together cancels a session, the client may choose a replacement appointment or a full refund.

 

12. Complaints and concerns

 

The client is encouraged to raise any concern directly with Thriving Together so that it can be addressed promptly.

Nothing in this agreement prevents the client from exercising any right to seek independent advice or make a complaint to an appropriate New Zealand agency.

13. Governing law

This agreement is governed by the laws of New Zealand.

If any part of this agreement is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Thriving Together Booking Policy

Thriving Together provides perinatal wellbeing and support sessions in clients’ homes or online, according to client preference and availability.

Booking and payment

Sessions must be booked in advance. Full payment is required online before the session.

A booking is confirmed once payment has been received and confirmation has been issued.

For home visits, clients are responsible for providing an accurate address and any relevant access or parking information.

Cancellations and rescheduling

Please provide at least 24 hours’ notice if you need to cancel or reschedule your session. Cancellations made with at least 24 hours’ notice may be rescheduled or refunded. Cancellations made with less than 24 hours’ notice are normally non-refundable.

  • If you need to cancel at short notice because you have gone into labour or are experiencing a perinatal emergency, the usual cancellation charge will not apply. Your session may be rescheduled or refunded, depending on your preference. You do not need to disclose more personal or medical information than is reasonably necessary when requesting this exception.

Late arrivals and missed sessions

If you are late, the session will usually finish at its original scheduled time.

If you do not attend an online session or are unavailable for a confirmed home visit without notice, the session will be treated as a late cancellation and the payment will not normally be refunded. If Thriving Together is delayed, you will receive your full booked session time wherever reasonably possible.

Online sessions

Clients are responsible for having a suitable device, internet connection and private space for an online session. If technical problems prevent the session from taking place, Thriving Together will work with you to find a reasonable solution, which may include reconnecting, changing to a phone call or rescheduling.

Cancellations by Thriving Together

If Thriving Together needs to cancel or reschedule a session, you may choose to transfer your payment to another available time or receive a full refund. Thriving Together is not responsible for other costs associated with the cancellation, such as childcare, travel or time away from work.

Emergencies and urgent care

Thriving Together provides wellbeing and support services but is not an emergency or crisis service. If you or your baby requires urgent medical assistance, contact your maternity care provider or local emergency services immediately.
